Vice President Sara Duterte is facing intensified scrutiny over allegations of constitutional breaches, specifically concerning transactions between the Davao City government, which she previously led, and Gencorp Industries Inc., a company in which she purportedly declared a business interest. Prosecutors are focusing on approximately P14.32 million in alleged transactions between Gencorp and the Davao City government spanning from 2022 to 2025, signaling a more aggressive strategy to pinpoint potential conflicts of interest.

These unfolding revelations hold significant implications for transparency and accountability within the Philippines' highest political office. The meticulous examination of corporate and procurement records, coupled with anticipated expert testimonies on constitutional prohibitions, reflects a growing public demand for unwavering integrity from elected officials and a clear separation between personal financial interests and official duties. The outcome of this inquiry could establish a critical precedent for future public servants regarding ethical conduct.

The heart of the new line of inquiry centers on the apparent conflict flagged by House prosecution adviser and spokesman Robert Ace Barbers, who stated, "There is a clear conflict of interest from the surface, we know it." This focus on specific corporate dealings represents a strategic shift from broader examinations of wealth declarations, aiming instead to identify direct violations of constitutional provisions.

The Senate impeachment court, which is set to resume its trial, is poised to hear from several key officials who are expected to authenticate a trove of government and corporate documents. Among the crucial witnesses scheduled to testify is Civil Service Commission Assistant Commissioner Ariel Ronquillo. He is expected to elaborate on the intricate rules governing the preparation and filing of Statements of Assets, Liabilities, and Net Worth (SALNs), including the guidelines he helped craft. His testimony is anticipated to provide the legal framework against which the Vice President’s declarations will be measured.

Further bolstering the prosecution's case is Gerardo del Rosario, director of the Securities and Exchange Commission (SEC) Company Registration and Monitoring Department. Del Rosario's testimony, which was deferred previously due to the sheer volume of corporate records, is now considered pivotal. He is tasked with authenticating SEC records related to companies where Vice President Duterte has declared business interests. These records are expected to build upon the earlier testimony of lawyer Karen Batu, an officer-in-charge from the Office of the Ombudsman's Central Records Division, who previously authenticated Duterte's SALNs and testified that the Vice President continued to list several business interests even after her election in 2022.

Additionally, Rendell Sopeña, division chief of the Philippine Government Electronic Procurement System (PhilGEPS), is slated to testify. Sopeña has been directed to produce documents of contracts involving Gencorp Industries Inc. and other entities in which Duterte reportedly declared an interest. This aspect of the testimony is critical for directly linking the Vice President's alleged business interests with actual government dealings, which could constitute a direct violation of ethical and constitutional provisions for public officials.

Constitutional experts have underscored the gravity of these unfolding revelations. Atty. Michael Yusingco, a constitutionalist and Senior Research Fellow at the Ateneo Policy Center, stated that the SEC testimonies and records could provide probable cause to examine whether Vice President Sara Duterte violated the constitutional prohibition on conflict of interest. This prohibition, outlined in Section 13, Article VII of the 1987 Philippine Constitution, explicitly bars the Vice President from holding any other office or employment during their tenure, a principle designed to prevent conflicts of interest and the undue concentration of power. The mere act of retaining a business interest that transacts with government, particularly one previously headed by the official, raises significant legal and ethical questions. A director of the Securities and Exchange Commission further emphasized this point, noting that the Vice President's role in a company while holding her current office could indeed be a possible constitutional violation.

The financial trajectory of Vice President Duterte has also come under intense scrutiny by House prosecutors. Rep. Zia Adiong questioned the source of Duterte's lawful income, citing SEC records that reportedly indicate companies she declared had incurred losses. Adiong highlighted that these records only deepen the questions surrounding the substantial increase in Duterte's declared net worth and whether her businesses could genuinely account for it.

These questions arise amidst earlier reports by Bicol Saro Party-list Rep. Terry Ridon, who revealed that Duterte's net worth increased by approximately P70 million, or 378 percent, from 2008 to 2024, reaching P88 million in 2024. Lawmakers are now considering requesting tax and business records of both Sara Duterte and her husband, Mans Carpio, to explain what has been termed a significant wealth gap. The House prosecution team's aggressive stance also includes plans to subpoena the Vice President's bank records once the Senate impeachment court is formally convened. Manila Rep. Joel Chua, a member of the House prosecution team, confirmed that the team is actively exploring legal avenues to obtain financial records relevant to the impeachment charges, especially those concerning alleged unexplained wealth. This move echoes previous scrutinies of the Duterte family's bank accounts, which have been subject to past allegations of massive undisclosed wealth.

The meticulous examination of corporate and procurement records, combined with expert testimonies on constitutional prohibitions, reflects a deepening commitment to democratic governance. It underscores the principle that public office is a public trust, demanding unwavering integrity and a clear separation between personal financial interests and official duties. This phase of the inquiry moves beyond general allegations, aiming for specific, document-supported evidence to ascertain potential constitutional breaches.

The current legal and political proceedings cast a long shadow, highlighting the critical importance of officials transparently declaring all business interests and strictly adhering to conflict-of-interest rules. As the Senate impeachment court prepares to delve into these complex records and testimonies, the nation watches closely, aware that the verdict on Vice President Duterte’s alleged violations will resonate far beyond her individual political career, potentially reshaping public expectations for ethical conduct at the highest levels of government.
